Service Description
Delaware Pest Control provides professional pest management, extermination, and prevention services to residential, commercial, and industrial clients throughout the state of Delaware. Our services include, but are not limited to, inspection and identification of pest infestations, treatment applications for insects and rodents, wildlife exclusion, termite control, bed bug remediation, mosquito reduction programs, and ongoing maintenance plans. All services are performed by licensed technicians in accordance with applicable federal and state pesticide regulations. Service scope, frequency, and specific treatment methods are determined based on property assessment, pest type, infestation severity, and the service agreement entered into between Delaware Pest Control and the client. We utilize integrated pest management approaches combining chemical, biological, and mechanical control methods as appropriate for each situation. Weather conditions, property accessibility, and environmental factors may affect service scheduling and treatment efficacy. Clients will receive advance notice of scheduled services unless emergency treatment is requested.
No Guarantee or Warranty
Delaware Pest Control does not guarantee complete elimination of all pests from any treated property. Pest biology, environmental conditions, neighboring infestations, and client actions beyond our control may result in persistent or recurring pest activity. Our treatments are designed to significantly reduce pest populations according to industry standards; however, complete eradication cannot be assured for all species or in all circumstances. We do not warrant against future infestations, damage caused by pests before or after treatment, or the absence of pests between scheduled services. Any retreatment services will be provided solely in accordance with the specific terms of your service agreement and at our sole discretion. Wood-destroying organism treatments are subject to separate warranty provisions if expressly purchased. This limitation of guarantees applies regardless of any verbal representations made by technicians or sales personnel.
User Responsibilities
Clients must provide accurate information regarding property conditions, prior treatments, health concerns, and pest observations to enable safe and effective service delivery. You are responsible for preparing the premises before our arrival, which may include removing pets, covering food preparation surfaces, securing valuables, and ensuring technician access to all relevant areas as specified in pre-service instructions. Failure to follow preparation guidelines may result in service refusal, additional charges, or reduced treatment effectiveness. You must promptly report adverse conditions, new pest activity, or concerns following treatment. Clients with children, elderly residents, pregnant individuals, or household members with respiratory conditions or chemical sensitivities must disclose these circumstances prior to service. You agree not to attempt self-treatment with over-the-counter products that may interfere with professional applications, and to maintain any exclusion repairs or sanitation improvements recommended by our technicians. Payment obligations must be satisfied according to agreed terms regardless of perceived treatment outcomes.
Limitation of Liability
To the maximum extent permitted by law, Delaware Pest Control's total liability arising from any service, whether in contract, tort, negligence, or otherwise, shall not exceed the total amount paid by you for the specific service giving rise to the claim. We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to property damage, personal injury, lost profits, emotional distress, or business interruption, even if advised of the possibility of such damages. This limitation applies to claims arising from pesticide exposure, treatment failures, property access incidents, or any other matter related to our services. You acknowledge that pest control involves inherent uncertainties and agree that our pricing reflects this allocation of risk. Certain jurisdictions do not permit limitation of liability for gross negligence or willful misconduct; this limitation shall apply to the fullest extent allowable under Delaware law.
Intellectual Property
All content, materials, trademarks, service marks, logos, trade names, photographs, videos, technical documentation, treatment protocols, and proprietary methodologies displayed or utilized by Delaware Pest Control are our exclusive property or licensed to us. This includes our website content, marketing materials, inspection reports, treatment plans, and customer portal features. You receive no license or right to use any intellectual property except as necessary to receive the contracted services. Client-provided feedback or suggestions may be incorporated into our operations without compensation or attribution. You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any of our materials without prior written consent. Technicians' field observations and recommendations documented in service reports constitute our confidential business information.
Governing Law
These Terms of Service and any dispute arising from your relationship with Delaware Pest Control shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you hereby submit to the personal jurisdiction and venue of such courts. The parties waive any objection to jurisdiction or venue on the grounds of inconvenience or forum non conveniens.
Changes to Terms
Delaware Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without prior individual notice. Changes become effective upon posting to our website or upon renewal of your service agreement, whichever occurs first. Material changes affecting existing service agreements will be communicated through the contact information you have provided. Your continued use of our services following any modification constitutes binding acceptance of the revised terms. We encourage you to review these terms periodically. The version in effect at the time services are rendered shall govern any dispute concerning those services.
